According to the Civil Code, rental companies are required to enter into a written agreement with their clients. This document indicates all the client’s passport data, place of work and registration, contact numbers, the cost of the rent that the client pays in advance, the cost of the rented item, the rental period (it cannot be more than a year). The contract even states the exact time by which the borrowed item must be returned: for example, if you rented something before 17.00, you must also return the property to the rental company before 17.00.

If you're a minute late, you'll pay for an extra day. By the way, a day is the minimum period for which you can rent a product: even if you needed something, for example a drill, for half an hour, you will have to pay as if you were drilling holes in the wall day and night.

The client’s right to cancel the rental early is also stipulated in the contract. According to the Civil Code, to do this you need to notify the rental companies in writing 10 days in advance: then you will be refunded the extra money for the rental.

However, it is not necessary to sign the agreement right away. First, the rental company must demonstrate to the client that the item really works and, at the client’s request, check all its functional features. The rental item must be accompanied by instructions and a warranty card; they must be kept by the client throughout the rental period.

If the equipment suddenly stops working during the warranty period, the client will need to take the item back to the rental, and he, in turn, is obliged to return the faulty equipment to a service center. If it turns out that the rental companies themselves are to blame for the breakdown, for example, the item was stored incorrectly, they will have to return the rental money to the client.

The client should meticulously inspect the rental item and insist that all scratches, roughness, broken corners and other minor defects be indicated in the property transfer deed - a document attached to the contract. Next, it’s worth asking: what exactly is the system of fines in this rental? This is not an empty precaution. Almost every rental company has its own instructions on the procedure for calculating penalties, which indicate the fines that the rental company will require for this or that damage. By signing a rental agreement, you automatically agree to all its terms, including fines. If you haven't looked up the cost of scratching your camera or karaoke machine in advance, the bill your rental company will give you may surprise you.

Moreover, the rental company will not return the deposit that you paid for the rented item until you pay all the fines.

"Play" before the trial

It’s not worth keeping an item for a long time, for example, because you’re very busy. There is usually no such thing as a “fine for late return” at rental stores: the client will simply have to pay for each day of delay, as for the day of rental. A “forgetful” client may face a different punishment. “The contract,” says Mikhail Emelyanov, an employee of the legal company Legas, “usually establishes how many days the client can with impunity (this does not mean free) not return the item to the rental company. After this period, the rental company has the right to sue the client.” If, according to the terms of the rental, the client has paid a deposit for the rented property, you should not expect reminders or calls from the rental companies. However, if the secured deposit did not cover the rental losses, the missing amount may be recovered from the client.

But if you haven’t paid a deposit, the rental companies will make a lot of efforts to find you: passport data and certificates from your place of work are not an empty formality.

If the matter comes to trial, the client will have to return the “lost” item to the rental company or reimburse its cost, as well as pay for each day of rental of the property: the amount can add up to a considerable amount. However, as Prokata.ru manager Olga Bodrova assures, in such cases, tormented by reminders, the regularity of which the MGTS service would envy, clients prefer to confess and pay off the rental companies before the trial.

“It is more difficult to collect a fine from the client for the damage with which he returned the rented item,” says lawyer Mikhail Emelyanov. “You can have your own opinion as to the extent of these damages and, accordingly, what amount should be reimbursed to the rental company.” In such cases, the client and rental companies usually resort to the help of an “arbiter”, which is a warranty workshop or service center.

There they finally determine what damage the client caused to the rental property and how much he will have to pay for it. The agreement that Prokat.ru concludes with clients states that the rented product must be returned in the same condition in which you received it. However, the law does not provide guidance on how to determine whether a particular abrasion is natural. Therefore, the client will always be to blame.

“Before renting,” says Olga Bodrova, manager of the Prokat.ru company, “the client should figure out whether renting is really more profitable for him than buying a similar item.” For example, renting an A60 digital camera from Prokata.ru for more than a month is extremely unprofitable. Even the most careful person will not be able to avoid causing a single minor damage to the camera or a single scratch.
